RELEASE, WAIVER OR RIGHTS AND HOLD HARMLESS AGREEMENT
Natural behavior in a dog culture includes jumping, biting, barking digging, chewing, chasing, etc. Our goal, as responsible dog owners, is to redirect that energy of undesirable behaviors into activities of desirable behaviors.
As much as we love our dogs, we as responsible dog owners must remember that our dogs are animals; our dogs are not little humans nor are they little children. Regardless, of how well trained our dogs may be, a dog can revert and display an undesirable behavior, like biting.
In consideration for the privilege, right and permission to train and attend the training sessions conducted by and for the Family Dog Center (hereinafter referred to as “FDC”) 6200 Berkshire Drive Suite 4 Crystal Lake, IL, I / we hereby agree to the following:
1. I/we hereby agree to waive any and all rights that I/we may, or in fact, have against the owners, employees, instructors or volunteers and authorized agents of FDC for any and all injuries to my person or property caused, or alleged to be caused, by any dog which is attending a class or activity, or has been trained by any instructor or volunteer of FDC or any of its authorized agents; and
2. I/we further hereby agree to hold harmless the owners, employees, instructors, volunteers and any authorized agents of FDC for any injuries caused, or alleged to be caused, directly or indirectly, to any person or property by my/our dog(s), and I/we shall personally assume all responsibility, including defense and liabilities for any such claims or actions; and
3. I/we further hereby agree to hold harmless the owners, employees, instructors, volunteers and or authorized agents of FDC from any claim for loss of my/our dog(s) by disappearing, theft, death, or otherwise, and from any claim for damage or injury to my/our dog(s), whether such loss, disappearance, theft damage, or injury caused or alleged to be caused by the negligence of the aforementioned persons or by the negligence of any other person, or any other cause or causes; and
4. I/we further hereby represent that, to the best of my/our personal knowledge, my/our dog(s) are not a hazard to persons or other dogs. I/we further represent that my/our dog(s) have been examined by a qualified veterinarian and found free from symptoms of contagious or infectious disease. All vaccinations, including bordetella (kennel cough) are to be current and up to date according to FDC requirements. A copy of your dog(s) most recent shot record is required along with this signed and dated waiver.
5. A parent, legal guardian or adult must accompany any minor participating in any FDC activity, including class sessions.
6. I/we understand that I must abide and conduct myself in accordance with the rules and regulations set forth by Family Dog Center.
7. I/we understand that NO REFUNDS will be issued.
8. I/we understand that there are NO MAKE-UP SESSIONS for classes that I have missed.
9. I/we understand that Family Dog Center has the authority to dismiss any handler or dog because of agressive behavior.
10. I/we understand that each participant who engages in a Family Dog Center class or activity expressly assumes the risk of engaging in and legal responsibility for injury, loss or damage to person or property resulting from the risk of Family Dog Center class or activity,
11. I/we understand that Family Dog Center has the right to transfer my dog to another class which is appropriate for its skill level, age and/or size.
12. I/we understand there is a $25.00 fee for all checks returned from the bank as 'NSF' non-sufficient funds.
13. I/we hereby swear,attest and affirm that my dog is free from fleas, worms, communicable parasites and diseases. As responsible dog owners, I/we will immediately inform Family Dog Center if my dog contracts any of the above or any conition that may pose a health risk. I understand that I will need a veterinarian release for my dog to return to class.
I/we have read the foregoing in its entirety and, with full understanding thereof, have affixed my/our signature hereto. I acknowledge and agree that a copy of this form shall have the same legal effect as an original.
